Affirmative action for Scheduled Castes means constitutionally authorised measures to remedy historic exclusion and improve access to education, public employment and political representation. It combines substantive equality, protective safeguards and reservations rather than relying only on formal equal treatment.
Equality and social justice foundations
Articles 14 and 15(4) permit equality to be pursued through special provisions for the advancement of Scheduled Castes. Article 15(5) enables admission-related measures in educational institutions, including private institutions, except minority educational institutions protected by Article 30(1).
- Article 17 abolishes untouchability and forbids its practice in any form.
- Article 46 directs the State to promote the educational and economic interests of Scheduled Castes and protect them from social injustice and exploitation.
Reservations in employment and representation
Articles 16(4) and 16(4A) enable reservation in public employment for inadequately represented backward classes and reservation in promotion, with consequential seniority, for Scheduled Castes and Scheduled Tribes. These are enabling provisions; the Constitution does not itself prescribe a uniform educational or service quota.
- Articles 330 and 332 reserve seats for Scheduled Castes in the Lok Sabha and State Legislative Assemblies.
- Articles 243D and 243T provide reservation for Scheduled Castes in Panchayats and Municipalities.
- Under Article 334, legislative seat reservations for Scheduled Castes and Scheduled Tribes presently continue until 2030.
Identification, safeguards and oversight
Under Articles 341 and 366(24), the President specifies Scheduled Castes for each State or Union Territory, while Parliament may include or exclude groups by law. Scheduled Caste status is therefore linked to the applicable constitutional list.
- The National Commission for Scheduled Castes under Article 338 monitors safeguards, investigates complaints and reports to the President.
- Article 335 requires consideration of Scheduled Caste and Scheduled Tribe claims in public services while maintaining administrative efficiency.
