Article 30 protects the educational autonomy of minorities based on religion or language. It guarantees them the right to establish and administer educational institutions of their choice, while also protecting such institutions against discriminatory denial of State aid and rights-destroying compulsory acquisition.

Core guarantees

  • Under Article 30(1), every religious or linguistic minority has the right to establish and administer educational institutions of its choice.
  • The expression "of its choice" allows minorities to establish institutions providing general, secular, technical or professional education, not merely institutions teaching their religion or language.
  • Administration includes selecting the governing body, admitting students, appointing staff and managing institutional affairs, subject to valid educational regulation.

Protection relating to property and aid

  • Under Article 30(1A), when the State compulsorily acquires property of a minority educational institution, the amount fixed or determined must not restrict or abrogate the Article 30(1) right.
  • Under Article 30(2), the State cannot discriminate in granting aid merely because an educational institution is managed by a religious or linguistic minority.
  • Article 30(2) prevents discriminatory denial of aid, but it does not create an absolute right to receive government aid.

Scope and permissible regulation

The Supreme Court in T.M.A. Pai Foundation v. State of Karnataka (2002) held that minority status is determined with reference to the State. The right protects meaningful institutional autonomy, but not maladministration.

  • The State may prescribe reasonable standards concerning academic excellence, teacher qualifications, health, discipline and fair administration, provided they do not destroy the institution's minority character.
  • An aided minority institution must also respect Article 29(2), which prohibits denial of admission solely on grounds of religion, race, caste, language or any of them.
