Election Administration in India and the United States

SyllabusComparison of the Indian constitutional scheme with other countries

PolityPublished 2 November 2026

Election administration means organizing and supervising elections, including voter registration, polling and counting. India constitutionally concentrates responsibility for major elections in the Election Commission of India, while the United States primarily assigns electoral administration to the states, subject to federal constitutional and statutory limits. The contrast is between a constitutionally centralized supervisory authority and a decentralized, state-based system.

India: a common constitutional election authority

India separates the authority that conducts elections from the legislatures that make electoral laws. Its federal structure does not give each state a separate commission to conduct parliamentary and state legislative elections.

  • Article 324 vests the superintendence, direction and control of electoral-roll preparation and elections to Parliament, state legislatures, and the offices of President and Vice-President in the Election Commission of India.
  • Articles 327 and 328 authorize Parliament and state legislatures respectively to legislate on electoral matters; state legislative power operates subject to parliamentary legislation.
  • Articles 243K and 243ZA separately place panchayat and municipal elections under State Election Commissions, rather than the Election Commission of India.

United States: state administration within federal limits

The United States has no nationwide election-management authority equivalent to India's Election Commission. States establish election-administration systems, with much operational work performed by county or other local officials under state law.

  • Article I, Section 4, the Elections Clause, gives state legislatures initial authority over the times, places and manner of congressional elections, while allowing Congress to make or alter such regulations, subject to the clause's stated exception.
  • Article II, Section 1 provides that each state appoints presidential electors in the manner directed by its legislature; Congress may determine the time of choosing electors and the day they vote.
  • State electoral arrangements remain subject to federal constitutional protections and federal legislation, including voting-rights requirements.
  • The U.S. Election Assistance Commission provides assistance and guidance to election administrators; it does not centrally conduct elections.

The central constitutional distinction

India centralizes electoral supervision without centralizing every administrative task: state and local officials assist in conducting elections under the Commission's authority. The United States decentralizes administrative responsibility while retaining federal safeguards and congressional regulatory powers.

  • India distinguishes national and state legislative elections from local-body elections through separate constitutional commissions.
  • The United States combines state-level institutional diversity with federal oversight, rather than placing all federal elections under one independent constitutional commission.
