Gram Sabha under Article 243A

The Gram Sabha is the body of all persons registered in the electoral rolls of a village within a Panchayat area. Under Article 243A, it is the constitutional platform through which village residents may directly exercise powers and perform functions assigned by state law, rather than acting only through elected Panchayat representatives.

Constitutional basis

Part IX was inserted by the 73rd Constitutional Amendment Act, 1992. Under Article 243A, a Gram Sabha may exercise such powers and perform such functions at the village level as the state legislature provides by law.

• This wording leaves the detailed authority of Gram Sabhas to state legislation, so their powers can vary across states.
• Unlike Article 243G, which concerns the devolution of powers and responsibilities to Panchayats, Article 243A specifically enables the village electorate to participate collectively.

Role in local self-government

The Gram Sabha provides a forum for direct participation, public deliberation and community oversight at the village level. Subject to state law, it may consider local plans, select or verify beneficiaries, review expenditure and question the functioning of the Gram Panchayat.

• It strengthens accountability by placing elected Panchayat representatives and local administration before the village electorate.
• It can connect local needs with planning and implementation across subjects devolved to Panchayats under the Eleventh Schedule, but it does not automatically receive all 29 subjects.

Special role in Scheduled Areas

The PESA Act, 1996 gives Gram Sabhas in Scheduled Areas a stronger statutory role consistent with customary community institutions.

• They are empowered to safeguard traditions, cultural identity, community resources and customary modes of dispute resolution.
• They approve village-level plans, programmes and projects before implementation and identify beneficiaries of poverty alleviation and other programmes.
• They certify the utilisation of funds by the Panchayat for village-level plans, programmes and projects.
