Municipal Taxation under Article 243X
SyllabusLocal government: Panchayats and municipalities
Municipal taxation is the raising of revenue by urban local governments through legally authorised taxes and related charges. Article 243X empowers the State Legislature, by law, to authorise municipal taxation and provide other financial resources; it does not directly confer an unrestricted taxing power on municipalities.
Constitutional authority and the role of State law
Article 243X is part of Part IXA, which was inserted by the 74th Constitutional Amendment Act, 1992. Its wording, “may, by law”, makes State legislation the mechanism for defining municipal revenue powers.
- The State Legislature may authorise a municipality to levy, collect and appropriate taxes, duties, tolls and fees, subject to the procedure and limits specified in the law.
- The provision does not itself impose a municipal tax, prescribe its rate or give every municipality an identical set of taxation powers.
- Article 265 requires that no tax be levied or collected except by authority of law; municipal taxation must therefore have a valid legal basis.
Four financial arrangements under Article 243X
The article enables State legislation to provide four distinct arrangements for municipal finance. Only the first concerns taxation exercised directly by the municipality.
- Municipal taxation: A municipality may be authorised to levy, collect and appropriate taxes, duties, tolls and fees within legally prescribed limits.
- Assignment of State revenues: Taxes, duties, tolls and fees levied and collected by the State Government may be assigned to a municipality for specified purposes and subject to specified conditions and limits.
- Grants-in-aid: State legislation may provide grants to municipalities from the Consolidated Fund of the State.
- Municipal funds: State legislation may provide for funds into which money received by, or on behalf of, municipalities is credited and from which withdrawals are made.
Significance for municipal fiscal autonomy
Article 243X supplies an enabling framework for municipal fiscal autonomy, but the actual extent of that autonomy depends on State law. Authorising local taxation differs from assigning State-collected revenues: the former enables municipal revenue collection, while the latter transfers revenue collected by the State.
- Under Article 243Y, the State Finance Commission constituted under Article 243I reviews municipal finances and recommends principles concerning revenue distribution, assignment of taxes and grants-in-aid.
- These recommendations complement Article 243X but do not themselves substitute for legislation authorising municipal taxes.
