Legal Framework of the National Register of Indian Citizens

The National Register of Indian Citizens (NRIC) is the statutory register intended to contain prescribed particulars of Indian citizens. Its legal foundation lies in the Citizenship Act, 1955, while the procedure for preparing and maintaining it is prescribed by rules made under that Act.

Constitutional and statutory basis

Citizenship falls within Parliament's legislative domain under Article 11 and Entry 17 of the Union List. Section 14A of the Citizenship Act, inserted by the Citizenship (Amendment) Act, 2003, authorises the Central Government to compulsorily register every citizen, issue national identity cards, maintain the NRIC and establish a National Registration Authority.

  • The Registrar General, India acts as the National Registration Authority and as the Registrar General of Citizen Registration.
  • The Central Government may appoint other registration authorities and prescribe the registration procedure.

Procedure under the Citizenship Rules

The Citizenship (Registration of Citizens and Issue of National Identity Cards) Rules, 2003 provide the operational framework. They contemplate local, sub-district, district and state registers forming part of the national register.

  • The process includes house-to-house enumeration, collection of prescribed particulars and verification of citizenship status by registration authorities.
  • The Rules provide for publication of a draft local register, claims and objections, appeals, final inclusion and issue of identity cards.
  • A Population Register covers usual residents, whereas the NRIC concerns citizens after the prescribed verification process.

Special framework for Assam

Rule 4A and the Schedule to the 2003 Rules prescribe a separate procedure for Assam. Applications are scrutinised with reference to the NRC of 1951, electoral rolls prepared before midnight of 24 March 1971 and other admissible documents under the prescribed process.

  • The Assam-specific procedure operates alongside the special citizenship provisions for Assam contained in Section 6A of the Citizenship Act.

Distinction from the Census

The population Census is conducted under the Census Act, 1948 and is legally distinct from citizen registration under the Citizenship Act and the 2003 Rules. Census enumeration by itself neither determines citizenship nor constitutes preparation of the NRIC.
