Plurilateral Agreements in the WTO

A multilateral agreement within the WTO applies to all WTO Members, whereas a plurilateral agreement applies only to the Members that accept it. Thus, the essential distinction is the scope of participation and legal obligations, not merely the number of countries involved in negotiations.

Legal distinction within the WTO

Under Article II:2 of the Marrakesh Agreement, the agreements in Annexes 1, 2 and 3 are integral to the WTO Agreement and bind every Member. Under Article II:3, an agreement in Annex 4 binds only those Members that have accepted it and creates neither obligations nor rights for other Members.

Participation and incorporation

Multilateral agreements establish common WTO disciplines across the membership, although countries may have different schedules and permitted flexibilities. Plurilateral agreements allow a willing group to undertake sector-specific or deeper commitments without requiring every Member to participate.

  • Adding an agreement to Annex 4 requires a decision of the Ministerial Conference taken exclusively by consensus, under Article X:9.
  • The existing Annex 4 agreements concern Government Procurement and Trade in Civil Aircraft.
  • A subset initiative does not become a formal Annex 4 agreement merely because several WTO Members negotiate it; its legal incorporation must follow WTO rules.

Trade policy significance

Plurilateralism can advance trade liberalisation where membership-wide agreement is difficult and can let willing Members adopt specialised rules. However, it may also produce fragmented obligations, exclude non-participants from negotiated benefits, and raise concerns about transparency, inclusiveness and consistency with the wider multilateral system.

  • Multilateral agreements provide wider coverage and greater uniformity, while plurilateral agreements provide greater negotiating flexibility.
  • The precise distribution of benefits depends on the agreement; plurilateral outcomes need not all operate identically toward non-participants.
