Right to Choose a Marital Partner

The Constitution protects an adult’s freedom to decide whom to marry as part of personal liberty under Article 21. This freedom rests on individual autonomy, privacy and dignity, so family, community or the State cannot substitute their preference for the voluntary choice of two competent adults. The choice remains subject to valid laws prescribing conditions for marriage.
Constitutional basis
Article 21 bars deprivation of life or personal liberty except according to procedure established by law. The Supreme Court has interpreted personal liberty to include decisional autonomy in intimate matters, while Articles 14 and 19 reinforce equality and freedom in making such choices.
- The constitutional protection applies irrespective of caste, community or religion, provided the persons are adults and legally competent.
- Social disapproval cannot by itself justify interference with a voluntary marital choice.
Judicial recognition
- In Lata Singh v. State of Uttar Pradesh, 2006, the Supreme Court affirmed that an adult is free to marry a person of her choice and condemned violence or harassment over inter-caste marriage.
- In Shafin Jahan v. Asokan K.M., 2018, the Court held that the right to marry a person of one’s choice is integral to Article 21 and that courts cannot assume a parental role over an adult’s decision.
- In Shakti Vahini v. Union of India, 2018, the Court treated choice of partner as intrinsic to liberty and dignity and issued preventive, remedial and punitive directions against honour-based interference.
Scope of protection
The right creates both a restraint and a protective duty for the State. Public authorities must not obstruct or invalidate an adult’s free choice merely because it defies social expectations, and they must provide protection against threats, coercion and violence.
- A court may examine whether consent is free, but once an adult’s independent choice is established, the merits of that choice are not for the court to decide.
- The freedom operates within valid statutory conditions concerning matters such as minimum age, prohibited relationships and an existing spouse.
