Election Rule-Making Power under Section 169

Vote-counting procedures under the Representation of the People Act, 1951 are prescribed through statutory rules made by the Central Government. Under Section 169, it may make these rules after consulting the Election Commission and notifying them in the Official Gazette.

Statutory rule-making authority

The Act defines “prescribed” as prescribed by rules made under it. Section 169 authorises the Central Government to make rules for carrying out the Act and expressly permits rules concerning the procedure for counting votes.

• The resulting framework is principally contained in the Conduct of Elections Rules, 1961.
• Consultation with the Election Commission of India is a statutory prerequisite to making these rules.

Roles during the counting process

The power to prescribe rules must be distinguished from the administration of an actual count. Under Section 64, votes are counted by, or under the supervision and direction of, the returning officer.

• The Election Commission issues administrative directions within the governing Act and rules, drawing authority from Article 324 of the Constitution.
• The returning officer implements the prescribed procedure and the lawful directions applicable to the particular election.

Publication and parliamentary control

Rules under Section 169 acquire legal form through notification in the Official Gazette. They must also be laid before both Houses of Parliament, which may modify or annul them in accordance with the section.
