Articles 371 to 371J, located in Part XXI of the Constitution, create state-specific arrangements to accommodate India's regional diversity within a common federal system. They embody asymmetrical federalism, under which some states receive distinct safeguards or institutional arrangements because their historical, social, cultural or developmental circumstances differ.

Core constitutional objectives

These provisions reconcile national unity with differentiated regional needs rather than imposing identical arrangements on every state.

  • They protect the customary laws, social practices and land rights of tribal communities, particularly in Nagaland and Mizoram.
  • They provide political representation and administrative attention to particular regions, including hill and tribal areas.
  • They promote balanced regional development through development boards and equitable allocation of state expenditure.
  • They seek fair access to education and public employment for residents of comparatively disadvantaged regions.
  • They facilitate the integration of states having distinctive historical circumstances while preserving appropriate local institutions and safeguards.

Principal constitutional instruments

The Constitution uses different mechanisms suited to each state's circumstances; it does not confer one uniform package of powers.

  • Under Articles 371A and 371G, parliamentary laws on specified customary, social, justice and land matters do not apply to Nagaland or Mizoram unless their Legislative Assemblies so resolve.
  • Articles 371B and 371C provide legislative committees or special administrative arrangements for tribal areas of Assam and the hill areas of Manipur.
  • Articles 371 and 371J support development boards, equitable development expenditure and regional opportunities in Maharashtra, Gujarat and the Hyderabad-Karnataka region.
  • Articles 371D and 371J permit arrangements concerning local opportunities in public employment and education in specified regions.
  • Articles 371F and 371H address distinctive governance needs in Sikkim and Arunachal Pradesh, including special responsibilities of their Governors.

Federal significance

These provisions make Indian federalism both territorially united and institutionally flexible. Their objective is substantive equality: differential treatment may be used to protect vulnerable identities, correct regional imbalance and strengthen participation without creating separate sovereignty.
