State Election Commissions under Article 243K
SyllabusRepresentation of the People Act and electoral reforms
A State Election Commission (SEC) is the constitutional authority responsible for conducting elections to local self-government bodies in a state. Article 243K vests in it the superintendence, direction and control of the preparation of electoral rolls for, and the conduct of, all elections to Panchayats.
Scope of the constitutional mandate
Article 243K places Panchayat elections under a constitutionally designated election authority rather than leaving their supervision to the state executive. Its mandate covers both the voter lists on which elections are based and the conduct of elections themselves.
- The Commission supervises the preparation of electoral rolls, which identify the persons entitled to vote in local elections.
- Its authority extends to all elections to Panchayats, not merely to a particular tier of the Panchayati Raj system.
- Article 243ZA similarly vests supervision of electoral rolls and the conduct of municipal elections in the State Election Commission.
- The SEC is distinct from the Election Commission of India, whose mandate under Article 324 covers elections to Parliament, state legislatures, and the offices of President and Vice-President.
Appointment and safeguards for independence
The Commission consists of a State Election Commissioner appointed by the Governor. Article 243K protects the Commissioner against arbitrary removal and adverse changes in service conditions, helping insulate local elections from executive pressure.
- The Commissioner cannot be removed except in the same manner and on the same grounds as a Judge of a High Court.
- The Commissioner's conditions of service cannot be varied to their disadvantage after appointment.
- Subject to any law made by the state legislature, the Governor may determine the Commissioner's conditions of service and tenure of office by rules.
Administrative support and electoral legislation
The Constitution combines the Commission's electoral authority with supporting responsibilities for the Governor and a lawmaking role for the state legislature.
- Under Article 243K(3), the Governor must, when requested by the Commission, make available the staff necessary to discharge its constitutional functions.
- Under Article 243K(4), the state legislature may make laws concerning matters relating to or connected with Panchayat elections, subject to the Constitution.
- The Commission must therefore exercise its mandate within the constitutional and statutory framework; the legislature's electoral lawmaking power does not displace the Commission's constitutional responsibility.
