Constitutional and Statutory Basis of the Census

A Census is the official enumeration of the population and the collection of specified demographic and related information. Its constitutional foundation lies in the Union's legislative competence over Census, while its detailed legal authority comes from the Census Act, 1948 and rules made under it.

Constitutional basis

Under Article 246, Parliament has exclusive power to legislate on subjects in the Union List. Entry 69 of the Union List specifically places the Census within the Union's legislative domain, ensuring countrywide legal and methodological uniformity.

• Census figures also support constitutional arrangements concerning representation and readjustment of constituencies under Articles 81, 82 and 170.

Statutory framework

Parliament enacted the Census Act, 1948 to provide the legal machinery for taking a census. Under section 3, the Central Government may declare by notification its intention to conduct a census throughout or in any part of India.

• The Act authorises the appointment of census authorities and officers, including the Census Commissioner, and assigns them census duties.
• Persons are legally required to answer prescribed census questions to the best of their knowledge or belief, while refusal or intentionally false answers may attract penalties.
• Under section 15, census records are protected from public inspection and are generally inadmissible as evidence in civil or criminal proceedings.

Rules and administration

The Census Rules, 1990, framed under section 18 of the Act, supplement the statute by prescribing operational procedures. The exercise is administered by the Office of the Registrar General and Census Commissioner, India, under the Union Ministry of Home Affairs.

• The Constitution and the Act do not prescribe a fixed ten-year interval; the decennial cycle is an established administrative practice.
