Suspension and Termination of Treaties

Suspension temporarily pauses treaty obligations, while termination ends the treaty prospectively. Under the Vienna Convention on the Law of Treaties, 1969, a bilateral treaty may be suspended or terminated under its own provisions, by mutual consent, or on limited grounds recognized by international law.
Treaty-based grounds and consent
The parties retain primary control over the life of their treaty.
- Under Article 54, termination or withdrawal may occur according to the treaty's provisions or at any time with the consent of both parties.
- Under Article 57, a treaty may similarly be suspended according to its provisions or by consent of both parties.
- Where a treaty contains no withdrawal clause, Article 56 permits denunciation only if the parties intended it or the treaty's nature implies it; at least twelve months' notice is required.
Grounds arising under international law
- A material breach under Article 60 allows the other party to invoke the breach as a ground for terminating the treaty or suspending it wholly or partly. It means an unlawful repudiation or violation of a provision essential to the treaty's object or purpose.
- Under Article 59, a later treaty on the same subject may terminate or suspend the earlier treaty where the parties so intend or the two treaties cannot be applied simultaneously.
- Under Articles 61-62, permanent impossibility of performance or a fundamental, unforeseen change of circumstances may justify termination; temporary impossibility may justify suspension.
- Under Article 64, emergence of a new peremptory norm of general international law makes a conflicting existing treaty void and terminates it.
Safeguards and limitations
These grounds are narrowly applied to protect the stability of treaty relations.
- Fundamental change cannot be invoked for a boundary treaty or where the invoking party caused the change through its own breach.
- Material breach cannot be used to suspend humanitarian provisions protecting the human person.
- Under Articles 65-67, the invoking state must notify the other party of its claim and reasons, follow the prescribed procedure, and formalize the measure in writing.
- Under Article 63, severance of diplomatic or consular relations does not itself end treaty relations unless those relations are indispensable for applying the treaty.
